Epic Parks, LLC, doing business as Lava Island (“Lava Island,” “we,” “us,” “our”) welcomes you. By accessing and using the Lava Island website, www.lavaisland.com (the “Site”), and our services, you accept and agree to be bound by these Terms of Service (“Terms”). If you disagree with these Terms, please do not use our Site or services.
1. Use of Our Services
You agree to use our Site and services solely for lawful purposes and in compliance with these Terms. If you are under 18, you must have your parent or legal guardian’s permission to use our Site and services. If you are a parent or legal guardian and allow your child to use our Site and services, then these Terms apply to you, and you are responsible for your child’s use of our Site and services.
2. Electronic Communications
You are communicating with us electronically by using our Site, sending us text messages, or emailing us. You consent to receive communications from us electronically, via text messages, emails, or notices posted on our Site.
3. Waivers
All adults must sign a waiver electronically through our WaiverFile platform prior to entry, which is available on our Site. This includes adding any children under your care to your waiver. A valid and annually updated waiver is required for entry into Lava Island, and you consent to the storage of your personal data.
4. Adult Chaperone Requirement
Children under 18 must be supervised by an adult chaperone at all times while at Lava Island.
5. Ticket Purchases and Events
All sales are final. We do not offer refunds or exchanges for tickets, food, beverages, birthday party packages, or event purchases. All purchases are non-transferable and must adhere to the dates selected. A non-refundable deposit is required at booking.
6. Birthday Parties
For birthday parties, we require a non-refundable deposit at the time of booking. This deposit is non-refundable under any circumstances.
7. Loyalty Program
Participation in our loyalty program is governed by the Terms outlined in the loyalty program policy.
8. Privacy
Our Privacy Policy, incorporated by reference into these Terms, describes our data practices. Please review it to understand how we handle your information.
9. Intellectual Property
You have permission to use our Site and services in accordance with these Terms. We retain any intellectual property rights we have on the Site and with our services.
10. Removal from Premises
We reserve the right to remove any individual from any Lava Island location without a refund for any reason including, but not limited to, rule violations, disturbances, or unsafe behavior.
11. Eligibility and Conditions
Participants and chaperones must comply with all park rules, policies, and instructions and assume the risks associated with all activities. Lava Island may modify operating hours or close without notice. Tickets are only valid at the purchase location.
12. Limitation of Liability
To the fullest extent permitted by law, Lava Island and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) using the Site; (ii) unauthorized access to our servers; (iii) your use or inability to use our services; (iv) any unauthorized access to or use of our servers and/or any personal information stored therein; (v) any interruption or cessation of transmission to or from our services; (vi) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Site or services by any third party; or (vi) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through our Site or services.
Lava Island is not liable for lost or stolen items.
Lava Island’s total liability arising out of these Terms is limited to the amount paid to use its services.
13. Indemnification
You agree to indemnify and hold harmless Lava Island and its affiliates from any claims, liabilities, damages, or expenses arising from your use or misuse of our services or your breach of these Terms.
14. Severability
If any provision of these Terms is declared or determined by any court of competent jurisdiction to be wholly or partially invalid or unenforceable, the remaining provisions shall not be affected thereby and the unenforceable provision shall be deemed not to be a part hereof.
15. Governing Law
These Terms and any disputes related to them will be governed by the laws of the State of Colorado.
16. Changes to These Terms
We reserve the right to update these Terms at any time. You are encouraged to review these Terms periodically on the Site. Your continued use of our Site and services after any changes is subject to the most current version of these Terms.
