Lava Island Loyalty Program Terms and Conditions

Introduction

Welcome to the Lava Island Loyalty Program (“Program”). These Terms and Conditions (“Terms”) govern your participation in the Program, which is operated by Epic Parks, LLC, doing business as Lava Island (“Lava Island,” “we,” “us,” “our”). By participating in the Program, you agree to these Terms. Your participation in the Program is conditional upon your acceptance of these Terms. 

Enrollment

  1. Eligibility: Membership in the Program is open to individuals at least 18 years old who possess the legal authority to agree to these Terms, agree to the Website Terms of Service (incorporated herein by reference), and consent to the Privacy Policy (incorporated herein by reference). By enrolling in the Program, you represent that you meet these eligibility requirements.
  2. Sign-Up: To enroll in the Program, you must provide your mobile phone number through our SQUARE POS system at a Lava Island location or https://app.squareup.com/loyalty/3EKZGF78FT9NK. By providing your phone number, you agree to these Terms, and consent to receive communications from us related to the Program.
  3. Participation: You must use the mobile phone number you enrolled with at the terminal at a Lava Island location to earn and redeem points. Points cannot be added retroactively or remotely. You must enter the phone number associated with your loyalty account prior to the completion of the transaction.

Earning Points

  1. Earning Structure:
    • You will earn one (1) point for every one-hour pass you purchase at full price. (Party packages do not apply)
    • You will earn two (2) points for every all-day pass you purchase at full price. (Party packages do not apply)
    • You will earn one (1) point for every small pizza you purchase at the Lava Island Café.  (Party pizzas do not apply)
    • You will earn two (2) points for every large pizza you purchase at the Lava Island Café. (Party pizzas do not apply)
  2. Point Accumulation: Points are accumulated in your account based on eligible purchases made using your mobile phone number at the terminal at a Lava Island location. Points have no cash value and cannot be exchanged for cash.
  3. Point Expiration: It is at our discretion when points expire; however, they will never expire before twelve (12) months. 

Redeeming Points

  1. Redemption: Once you accumulate ten (10) points, you can redeem those points for one all-day admission pass at any Lava Island location.
  2. Redemption Process: To redeem points, you must use your mobile phone number at our terminal. Points can only be redeemed in person at a Lava Island location.
  3. Restrictions: Points are non-transferable and can only be redeemed by the account holder.  Members may not sell points to others.  Points have no cash value and cannot be exchanged for cash.

Program Limitations

  1. Non-Retroactive: Points cannot be added retroactively if you forget to enter your phone number during a transaction. It is your responsibility to ensure your phone number is entered at the time of purchase.
  2. Changes to Program: We reserve the right to modify, suspend, or terminate the Program or these Terms at any time, with or without notice. Any changes will be effective immediately upon posting the revised Terms on our Site.
  3. Program Termination: If the Program is terminated, any unused points will be forfeited.

Privacy

  1. Data Collection: By enrolling in the Program, you consent to the collection, use, and sharing of your personal information (including your mobile phone number) in accordance with our Privacy Policy.
  2. Communication: You agree to receive communications from us regarding your participation in the Program. You can opt-out of receiving marketing communications at any time, but you will continue to receive transactional messages related to the Program.

Liability and Disclaimers

  1. No Warranty: The Program is provided “as is” and “as available,” without any warranties of any kind, either express or implied.
  2. Limitation of Liability: To the maximum extent permitted by law, Lava Island will not be liable for any damages of any kind arising from or in connection with your participation in the Program, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
  3. Indemnification: You agree to indemnify, defend, and hold harmless Lava Island, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney fees, arising out of or in any way connected with your participation in the Program.

Severability

If any provision of these Terms is declared or determined by any court of competent jurisdiction to be wholly or partially invalid or unenforceable, the remaining provisions shall not be affected thereby and the unenforceable provision shall be deemed not to be a part hereof.

Governing Law

These Terms and any disputes arising out of or related to the Program will be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles.
